General

ABCS hosts the ABCS web site at which users can access databases relating to intellectual property. This User Agreement sets forth the terms and conditions governing the access and use of our site by you, the user. If you use our web site, you agree to comply with the applicable terms and conditions of this User Agreement.

Permitted Uses

The ABCS Web Site is owned and operated by ABCS Safety Training Inc.  All materials appearing on this site, including site design, text, graphics, icons interfaces, and the selection, assembly and arrangements are owned or licensed by ABCS. Permission is granted to electronically copy and to print hard copy portions of these materials only as described below or elsewhere on this site. Any other use of materials on this site, including but not limited to, reproduction for purposes other than those noted on our site, modification, transmission, display, distribution or republication, without the prior written permission of ABCS is strictly prohibited. Elements of the site are also protected by trademark, copyright, trade dress and other laws and may not be imitated in whole or in part on other web sites.

Web Site Content

Some of the content in the ABCS web site is provided by third parties. ABCS is not responsible for the content of any of this third party data, nor is ABCS responsible for the completeness or accuracy of any such data.

Links

When using our web site, you may sometimes be linked to other web sites. These web sites are not operated by ABCS, and you may be required to agree to additional terms and conditions in order to access information or services from these web sites.

Registration

In order to access certain portions of our site, gain access to certain databases and purchase the products and services available on our site, you must register with ABCS by completing the applicable registration form. If you do not register, you will not be able to access our entire site. By registering, you agree to comply with the terms and conditions of your registration form as well as this User Agreement.

Eligibility

Registration on our web site is limited to persons who are eligible to enter into contracts under applicable law. This means, among other requirements, you must be 18 years of age or older to be accepted as a registered user of our web site. If you do not meet these requirements, you cannot register on our web site. ABCS reserves the right to reject your application to become a registered user. ABCS also reserves the right to suspend user privileges and block access of any registered user who violates this User Agreement.

User ID

When you register, you will be asked to create your own unique User ID which you will need in order to access certain areas of our web site. You agree that the User ID is only for your personal use, and you will not permit anyone else to use your User ID. You may not transfer your User ID to anyone else.

Complete and Accurate Information

You represent and warrant, that is, you promise, to ABCS that the information contained in the registration form is complete and accurate. It is your responsibility to keep your registration current.

Privacy

ABCS shall keep all information you provide to ABCS confidential and private in accordance with our privacy policy. See privacy policy to review ABCS’s privacy policy.

Termination

You may terminate your registration on our web site at any time by providing written or email notice to ABCS at the address set forth on our web site. ABCS also reserves the right to terminate your registration. All applicable provisions of the Agreement will survive termination of this Agreement. If you have not logged onto the site at any time for over six months, ABCS reserves the right to terminate your registration. This means ABCS can disable your User ID and terminate your account. If this occurs, and you still want access to the ABCS Site, simply contact ABCS by writing to ABCS Inc., Attn: Customer Support, 14930 118 Ave. NW, Edmonton, AB, T5V 1B8, or admin@albertabcsafety.com, and your account can be re-established. In addition, Users automatically receive newsletters and other communications from ABCS. If you prefer not to receive these communications, you can, at any time, cancel your account by contacting us by email at admin@albertabcsafety.com or in writing at ABCS, Inc., Attn: Customer Support, 14930 118 Ave. NW, Edmonton, AB, T5V 1B8.

DISCLAIMER OF WARRANTIES

ACCESS TO THE ABCS WEB SITE AND ITS CONTENT, PRODUCTS AND SERVICES ARE PROVIDED “AS IS.” ABCS DOES NOT MAKE ANY WARRANTIES OR REPRESENTATIONS, EXPRESSED OR IMPLIED, CONCERNING THE MERCHANTABILITY, QUALITY, NON INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE OF OUR WEB SITE OR ITS CONTENT, PRODUCTS OR SERVICES. YOU ASSUME ALL RISK OF USE. NO WARRANTY IS GIVEN THAT THE SERVICES WILL BE ERROR-FREE, FREE OF VIRUSES OR UNINTERRUPTED. ABCS IS NOT RESPONSIBLE FOR INVALID DESTINATIONS AND TRANSMISSION ERRORS IN, CORRUPTION OF, OR THE SECURITY OF INFORMATION CARRIED OVER TELECOMMUNICATIONS CARRIERS’ OR OTHER PROVIDERS’ FACILITIES. ABCS HAS NO LIABILITY FOR FAULTY OR INTERRUPTED COMMUNICATION LINKS, OR EMAILS, NOR FOR THE CONTENTS OF ANY SUCH COMMUNICATIONS.  YOU ACKNOWLEDGE THAT SUBSTANTIAL AMOUNTS OF THE CONTENT OF THE WEB SITE ARE PROVIDED BY THIRD PARTIES, AND ABCS HAS NO CONTROL OVER, OR LIABILITY FOR ANY SUCH CONTENT. UNDER NO CIRCUMSTANCES WILL ABCS BE RESPONSIBLE FOR THE USE BY YOU OF, OR RESULTS ACHIEVED BY YOU FROM THE SERVICES OR ANY DATA ACCESSED THROUGH THE WEB SITE.

LIMITATION OF LIABILITY

ABCS SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES INCURRED ARISING OUT OF THE USE OR THE INABILITY TO USE THE SERVICE, OR OUT OF ANY BREACH OF A REPRESENTATION OR WARRANTY, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, EVEN IF ABCS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE OR LOSS.

General Compliance with Laws

You agree to comply fully with all applicable laws, statutes, ordinances, rules and regulations, and agree not to use our web site to facilitate collusion or for any other conduct violating antitrust or other applicable laws.

Notices

In addition to posting a notice on its web site, ABCS may notify you by email, by facsimile or by certified mail, postage prepaid and return receipt requested, to the address(es) or facsimile number provided to ABCS during the registration process. In such case, notice shall be deemed given 1 day after being sent by email or facsimile or 3 days after the date of mailing.

Amendments and Modifications

ABCS reserves the right, in its sole discretion, to supplement, modify or discontinue any aspect of our web site, including, without limitation, restricting the times or means of access to our web site. ABCS also reserves the right, in its sole discretion, to modify this Agreement in any manner and to adopt additional terms or conditions governing your access and use of our web site, and the terms and conditions related to the access and use of our web site, at any time, without prior notice. The terms of any such amendment to this Agreement shall become effective immediately upon posting of such terms on our web site, and your use of our web site on or after such effective date shall constitute acceptance of such amended terms.

Independent Contractors

The relationship of ABCS with you is that of independent contractors, and no agency, partnership, joint venture, employment or other similar relationship is intended or created by your acceptance of the terms of this Agreement or the use of our web site.

Entire Agreement

This Agreement sets forth the entire understanding between ABCS and you with respect to the subject matter of this Agreement and supersedes any previous and contemporaneous communications, representations, understandings and agreements, whether oral or written, between ABCS and you with respect to said subject matter.
